In doing so, the court expressly departed from its previous case law.<\/p>\n<p>The case involved an employer&#8217;s termination of an employment contract during the probationary period, after the contract was signed but before the employee started working. Lower courts had concluded that the dismissal was not genuinely related to the employee&#8217;s suitability for the position and that the reason for termination fell outside the purpose of probation.<\/p>\n<p>The Senate used this case as an opportunity to reconsider its previous approach. The judgment reinforces the distinction that, while probation allows employers to assess an employee&#8217;s suitability for the role, courts should not automatically conduct a broad review of the employer&#8217;s business judgment regarding the employee&#8217;s performance. The employer is entitled to subjectively assess an employee\u2019s suitability, including their reliability, reputation, and the truthfulness of previously provided information, even before work actually begins.
